An Act to amend the Fire Protection and Prevention Act, 1997 to require the retrofitting of retirement homes with automatic sprinklers

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

   1.  Subsection 1 (1) of the Fire Protection and Prevention Act, 1997 is amended by adding the following definition:

“retirement home” means a retirement home as defined in subsection 2 (1) of the Retirement Homes Act, 2010; (“maison de retraite”)

   2.  The Act is amended by adding the following Part:

Requirement to retrofit retirement homes

Application

   11.1  (1)  This section applies to the owner and the operator of a building or a part of a building that is used as a retirement home and that is not otherwise required under this Act or the Building Code Act, 1992 to be equipped with a system of automatic sprinklers.

Requirement

   (2)  The owner and the operator of a building or a part of a building described in subsection (1) shall ensure that,

  (a)  the building or the part of the building is equipped with a system of automatic sprinklers that is installed in accordance with the regulations made under the Building Code Act, 1992; or

  (b)  if a system of automatic sprinklers is already installed in the building or the part of the building on the day the Fire Protection and Prevention Amendment Act (Retrofitting of Retirement Homes with Automatic Sprinklers), 2012 receives Royal Assent, the installed system has been approved by the Chief Fire Official as providing protection equivalent to the protection provided by a system mentioned in clause (a).

Commencement

   3.  This Act comes into force on January 1, 2018.

Short title

   4.  The short title of this Act is the Fire Protection and Prevention Amendment Act (Retrofitting of Retirement Homes with Automatic Sprinklers), 2012.

 

EXPLANATORY NOTE

The Bill amends the Fire Protection and Prevention Act, 1997 to require that all retirement homes be retrofitted with a system of automatic sprinklers.
